These Terms of Use ("Terms") apply to the Mushroomy iOS application and related services provided by Yehor Ivanov ("Mushroomy", "we", "us", or "the Service Provider"). By downloading, accessing, purchasing, or using Mushroomy, you agree to these Terms. If you do not agree, do not use the application.

1. No guarantee of mushroom identification or edibility

Names, descriptions, seasons, categories, search results, calendars, forecasts, icons, images, drawings, and other information in Mushroomy are provided for general educational and informational purposes only. They must not be treated as a definitive identification of a real-world specimen or as a recommendation that a mushroom is edible, safe, medicinal, non-toxic, or suitable for any particular use.

A mushroom shown as "edible" or otherwise described in a category may still be unsafe in a particular situation because of misidentification, look-alike species, individual allergies or intolerance, contamination, spoilage, preparation method, local environmental conditions, or other factors outside the app's control.

2. Illustrations, images, and visual content may be inaccurate

Mushroomy may use drawings, icons, stylized artwork, schematic illustrations, edited images, or other visual representations. These visuals are not guaranteed to be botanically or mycologically exact. Color, shape, scale, texture, gill structure, stem details, habitat, and other characteristics may be simplified, omitted, exaggerated, stylized, or displayed differently from a real specimen. Device screens and lighting may also alter how colors appear.

You must never rely on an illustration or image in Mushroomy as the sole basis for identifying, collecting, touching, preparing, or eating a mushroom.

3. Your responsibility when collecting or consuming mushrooms

You are solely responsible for decisions you make regarding wild mushrooms. Before consuming any mushroom, verify it using multiple authoritative sources and, where safety or edibility is in question, consult a qualified local mycologist, mushroom-identification expert, poison-control authority, or other competent professional.

If you believe that you or another person may have eaten a toxic or incorrectly identified mushroom, seek emergency medical assistance and contact the appropriate poison-control service immediately. Do not wait for symptoms and do not use Mushroomy as a substitute for emergency or professional advice.

4. Forecasts, seasons, and foraging-condition indicators

Weather-based forecasts, seasonal information, "good day" indicators, historical trends, reminders, and similar features are estimates intended to help with planning. Mushroom growth depends on many environmental and local variables. Mushroomy does not guarantee that mushrooms will be present, absent, safe, legal to collect, or in good condition at any place or time.

5. Local laws, land access, and environmental responsibility

You are responsible for complying with local laws, protected-area rules, private-property rights, collection limits, permits, and any other rules that apply where you forage. Mushroomy does not grant permission to enter property, remove natural resources, or collect protected species.

6. License to use Mushroomy

Subject to these Terms and applicable App Store rules, the Service Provider grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use Mushroomy on devices that you own or control. You may not copy, sell, rent, sublicense, reverse engineer, decompile, or create unauthorized derivative versions of the application except where applicable law expressly permits it.

7. Intellectual property

The application's code, interface, branding, text, original artwork, icons, layouts, and other protected content are owned by the Service Provider or used under appropriate rights, except for third-party materials identified as such. These Terms do not transfer ownership of Mushroomy or its intellectual property to you.

8. Photo Calendar and user-selected content

If you add photos or captions to Mushroomy, you remain responsible for that content and for ensuring you have the right to use it. Do not use the app to store content that is unlawful or infringes another person's rights. Mushroomy is not intended to be your only backup for important photos or records.

9. PRO subscriptions and free trials

Mushroomy may offer optional auto-renewable monthly and yearly subscriptions ("Mushroomy PRO"). The exact price, billing period, included features, and any introductory offer are shown in the app and in the App Store before purchase. Prices can vary by country or region and may change in accordance with Apple's rules.

• Payment is processed by Apple through your Apple Account.
• Subscriptions renew automatically unless canceled through Apple's subscription-management system before the next renewal.
• You can manage or cancel an active subscription in your Apple Account / App Store subscription settings.
• Free trials or introductory offers, when available, are subject to Apple's eligibility rules and may be available only to eligible users.
• Restoring purchases requires the Apple Account associated with the original eligible purchase.

Mushroomy does not control Apple's billing systems, refund decisions, taxes, storefront pricing, or eligibility determinations. Apple's applicable media-services and App Store terms also apply to purchases made through Apple.

10. Availability and changes

We may update, add, remove, or change features, species entries, forecasts, subscription benefits, visual content, and other parts of Mushroomy. We do not guarantee uninterrupted or error-free operation, permanent availability of any particular feature, or compatibility with every future device or operating-system version.

11. Third-party services

Mushroomy may rely on Apple services and third-party data services, such as weather or forecast providers. Their availability, accuracy, and terms are outside our direct control. We are not responsible for third-party outages, data errors, or decisions made by those providers, subject to rights that cannot be excluded by law.

12. Limitation of liability

To the fullest extent permitted by applicable law, the Service Provider does not accept liability for losses, injuries, illness, poisoning, allergic reactions, property damage, lost data, missed opportunities, or other harm arising from reliance on Mushroomy for mushroom identification, edibility, food safety, medical decisions, foraging locations, forecasts, illustrations, or other informational content.

This limitation does not exclude or limit liability that cannot legally be excluded, including any mandatory consumer rights or other non-waivable obligations under applicable law.

13. No warranties

To the extent permitted by law, Mushroomy is provided on an "as is" and "as available" basis. Information may contain errors, omissions, outdated material, or inaccuracies. We do not warrant that the app's content is complete, exact, continuously updated, or suitable for making health, safety, or consumption decisions.

14. Termination

You may stop using Mushroomy at any time. We may suspend or discontinue parts of the service where reasonably necessary for security, legal compliance, abuse prevention, technical reasons, or product changes. Termination of app access does not automatically cancel an App Store subscription; subscriptions must be managed through Apple.

15. Privacy

Use of Mushroomy is also governed by the Mushroomy Privacy Policy.

16. Changes to these Terms

We may update these Terms when Mushroomy changes or when legal requirements change. The current version will be posted on this page with an updated effective date. Continued use after an update constitutes acceptance to the extent permitted by applicable law.
